Terms and Conditions

1. Introduction

These Terms and Conditions apply to https://andrasferencz.ro (the "website"), the personal website of András Ferencz, owned and operated by Affarit Studio SRL ("we", "us", "our"), and to the free resources, newsletter and services offered through it. You may be bound by additional contracts with us, for example for consulting or development work; where they conflict with these Terms, the additional contract prevails.

2. Binding

By accessing or using the website you agree to these Terms. Using the website implies that you know and accept them. In some cases we may also ask you to agree explicitly.

3. Electronic communication

By using the website or contacting us electronically, you agree that we may communicate with you electronically, on the website or by email, and that such communications satisfy any legal requirement that they be in writing.

4. Intellectual property

We or our licensors own the copyright and other intellectual property rights in the website and its content: articles, free resources, templates, images and code samples.

4.2 Free resources

The free resources (playbooks, kits, checklists and templates) are for your personal use and your own work. You may use the templates and code samples in your own projects. You may not resell them, republish them as your own, or offer them as a download elsewhere. Link to the resource instead; we are always happy when you do.

5. Newsletter and signups

You may forward our emails to people who may be interested. When you sign up, you agree to give accurate information. You can unsubscribe at any time with the link in every email.

6. No professional advice

Articles and free resources share experience and opinions. They are not legal, financial or other professional advice, and following them is at your own risk. Facts about tools, platforms and store rules change: check the current official documentation before you rely on them.

7. Third-party websites

The website links to other websites, such as Substack, Gumroad, Google Calendar, LinkedIn and affarit.com. We do not control them and are not responsible for their content, products or privacy practices; their own terms apply.

8. Responsible use

You agree to use the website only for its intended purposes and in line with these Terms and applicable law. You must not publish or distribute malicious software through it, use data collected from it for direct marketing, or run systematic or automated data collection against it in a way that harms its performance. Reading and indexing the public pages by search engines and AI assistants, as allowed by our robots.txt, is welcome. You must not do anything that damages the website or interferes with its availability, or try to get around its access restrictions.

9. Idea submission

Please don't send us ideas, inventions or other intellectual property you want to protect unless we have first signed an agreement, such as a non-disclosure agreement. If you share it without one, you grant us a worldwide, irrevocable, non-exclusive, royalty-free licence to use it.

10. Changes and availability

We may change, suspend or discontinue the website or any free resource at any time. We are not liable to you or anyone for any such change, suspension or discontinuance.

Nothing in this section limits any warranty implied by law that it would be unlawful to limit. We may update these Terms. The date above is the latest revision, and changes take effect when they are posted. Continuing to use the website after a change means you accept it.

21. Governing law and jurisdiction

These Terms are governed by the laws of Romania, and disputes are subject to the jurisdiction of the courts of Romania. If any provision is found invalid, it is enforced to the maximum extent permissible and the rest of these Terms remains in effect.
